Our Terms of Service (TOS) are established between you, the entity you represent, and Azure Sea Tech Limited. This agreement pertains to the downloading and use of Azure Sea Tech Limited’s product, the SMO (Small Mobile Office) suite (hereinafter referred to as “SMO”). It describes the rights and obligations between you and the software.

Please carefully read and fully understand the content of this agreement before registering. If you have any issues, you may choose not to access this TOS. Once you confirm this agreement, it will have legal effects between you and this application, indicating that you fully agree to and accept all terms of this agreement. 

Our Services

SMO (Small Mobile Office) is a Software as a Service (SAAS) integrated system developed by Azure Sea Tech Limited. It includes instant messaging, team collaboration, cloud customer service, and other features to help small teams communicate and manage more efficiently. You may use the SMO services as an individual or on behalf of a company. You are responsible for obtaining internet access and the necessary equipment required to use our services. Within your SMO account, you can create and edit content, and publish or share it publicly with others.

Your Account

To access and use the SMO services, you need to provide the required information and register a user account. If you are representing a company, we recommend that you and all employees register with a company email address and provide company contact information.

  1. Obtaining an Account: You can obtain your SMO account in the following ways:
    1. When you fill in the information as prompted on the registration page, read and agree to this Agreement, and complete all registration procedures, you will receive an SMO account and become an SMO user.
    2. When you log in to SMO through a third-party authorization process, you authorize SMO to collect identifying personal information from your third-party account, such as your username and avatar. Upon completing the authorization, you will receive an SMO account and become an SMO user.
  2. Account Usage: To facilitate user login, you can use your account to access other services under the SMO domain. If there are special circumstances, the actual login situation shall prevail.
  3. Single User Identification: Any accounts verified with the same identity information, phone number, or accounts determined by SMO to be under the control of the same individual are regarded as the same user.
  4. Authenticity of Information: You must register using authentic identity information, and your submitted account name, avatar, bio, and other registration details must not contain illegal or inappropriate content. If issues are found, SMO will not register the account. Additionally, if you are found to have used false information to obtain an account name, or if your account avatar, bio, or registration information contains illegal or inappropriate content, or infringes upon the legal rights of others, SMO may take corrective actions, including but not limited to, requesting a modification, suspending the account, canceling the registration, or reclaiming the account.

General Use and Restrictions

  1. Users fully understand and agree that SMO only provides a platform for sharing, transmitting, and accessing information. Users are solely responsible for all actions taken under their registered account, including any content they transmit and any consequences thereof. Users should independently evaluate the content on SMO and assume all risks arising from the use of the content, including any reliance on the accuracy, completeness, or usefulness of the content. SMO cannot and will not be held liable for any loss or damage resulting from user actions.
  2. Any content transmitted by users within SMO services or through SMO does not reflect SMO’s views or policies, and SMO assumes no responsibility for such content.
  3. Users fully understand and agree that SMO is a point-to-point instant communication product based on a user relationship network. Users are solely responsible for the authenticity, legality, and validity of their registration information on SMO. Users may not impersonate others, use another person’s identity to transmit information, or maliciously use their registered account. Otherwise, SMO reserves the right to immediately terminate service, reclaim the SMO account, and hold the user solely accountable for any resulting legal liabilities.
  4. Users are fully responsible for the authenticity, legality, and validity of the information they transmit on SMO. Any legal liability related to the information users distribute is solely their responsibility and has no connection to SMO.
  5. SMO reserves the right to modify, suspend, restrict, terminate, or revoke all or part of the services at any time, without notice, due to development needs. Users must assume this risk.
  6. The services provided by SMO may include advertisements, and users agree to the display of advertisements from SMO and third-party suppliers or partners during their use of the services.
  7. Users must not use SMO or its services to create, upload, copy, or transmit any content that:
    1. Opposes the fundamental principles established by the constitution;
    2. Endangers national security, discloses state secrets, subverts state power, or undermines national unity;
    3. Incites ethnic hatred or discrimination;
    4. Undermines religious policies, promotes cults, or propagates feudal superstitions;
    5. Spreads rumors, disrupts social order, or undermines social stability;
    6. Distributes obscene, pornographic, gambling-related, violent, murderous, terroristic, or criminally inciting content;
    7. Insults or defames others, or infringes on the legitimate rights and interests of others;
    8. Contains any other content prohibited by laws and administrative regulations.
  8. SMO has the right, at its reasonable discretion, to stop transmitting any content that violates relevant laws, regulations, or the provisions of this Agreement; or that infringes upon, threatens, or harms the rights or safety of any person, or involves impersonation. SMO also reserves the right to take appropriate legal action against anyone violating these terms, including but not limited to, removing illegal, infringing, or inappropriate content from the SMO services, terminating the violator’s membership, preventing them from using some or all of SMO services, and, as required by law, retaining relevant information and reporting to the appropriate authorities.
  9. User Rights and Obligations:
    1. Ownership of the SMO account belongs to the company that owns SMO. Upon completing the account registration process, users obtain the right to use the SMO account. This right is exclusive to the initial registrant and may not be gifted, loaned, leased, transferred, or sold. SMO reserves the right to reclaim a user’s SMO account.
    2. Users have the right to change or delete their personal information, registration information, and content on SMO. However, users should be aware that deleting information will also delete any text and images stored within the system. Users must assume the risk associated with this action.
    3. Users are responsible for safeguarding the security of their registration information and account password. Users assume legal responsibility for all actions taken with their registered account and password. Users agree not to use another member’s account or password under any circumstances. If you suspect unauthorized use of your account or password, you agree to notify SMO immediately.
    4. Users should comply with all provisions of this Agreement and use the service correctly and appropriately. If a user violates any terms of this Agreement, SMO has the right to terminate the user’s SMO account services. Additionally, SMO reserves the right to reclaim any SMO account or username at any time.
    5. If a user does not log in to their SMO account for an extended period (120 consecutive days), SMO reserves the right to terminate the account to prevent resource waste. Any issues arising from this will be the user’s sole responsibility.

Disclaimers

SMO fulfills its basic obligations as required by law, but it is not liable for any obstacles, defects, delays, or changes in service performance caused by the following reasons:

  1. SMO may periodically or occasionally inspect or maintain the network service platform or related equipment. SMO assumes no liability for service issues caused by routine or emergency equipment and system maintenance, equipment and system failures, or issues related to network information and data security, as long as SMO has acted in good faith.
  2. Events of force majeure, such as natural disasters, strikes, riots, wars, government actions, judicial or administrative orders, epidemics, and other similar events.
  3. Issues resulting from malfunctions or adjustments by basic service providers or relevant authorities.
  4. Temporary closures, service adjustments, or other disruptions caused by government regulations.
  5. Failures in your own computer hardware or software, communication lines, or power supply lines.
  6. Issues caused by viruses, trojans, malicious attacks, network congestion, system instability, system or equipment failures, communication failures, power outages, banking issues, third-party service defects, or government actions.
  7. Notwithstanding the provisions above, SMO will take reasonable actions to actively restore services to normal as soon as possible.

Billing

The SMO service offers versions with different subscription terms, and you may purchase a paid version of the SMO product on a monthly or annual basis. As your subscription nears its end, please ensure timely renewal. You should renew within 14 days following the service expiration date, during which SMO will maintain your original version of the service. If you do not renew within this grace period, we will assume you no longer wish to use the paid version of SMO, and your service will automatically downgrade to the free version.

We may occasionally adjust the fees for currently free services. However, any fee increases will not apply until the end of your current subscription period. Unless you opt for a paid subscription, you will not be charged any service fees.
